We’re pleased to announce that we have reached a preliminary settlement in our class action lawsuit against Paradise Grills (“Paradise“). The case, filed in January 2023, has been actively litigated by both parties.
The Plaintiff’s allegations, both individually and on behalf of the proposed class, are based on the contention that Paradise Grills’ outdoor kitchen units were designed or manufactured without adequate ventilation around the grill’s propane chamber. This lack of proper ventilation causes a dangerous buildup of propane gas within the units’ propane chambers, leading to explosions, combustion, and other malfunctions. Consequently, the value of the units is significantly reduced, and the proposed class members are exposed to an unreasonable risk of harm.
Under the terms of the settlement, Paradise Grills will “retrofit any qualifying Outdoor Kitchen Unit by installing and replacing, or shipping the Class Member a vent for their Outdoor Kitchen Unit consistent with the GexCon U.S. Report dated March 19, 2024.” Additionally, Paradise Grills “will schedule and complete a free service call to install the vent for Settlement Class Members located in Florida, Texas, Georgia and Alabama.”
Class action attorney Eduardo A. Maura stated, “We’re pleased with the settlement. It required marathon-like efforts and long hours of work, but we believe it represents a fair compromise. We think it adequately addresses the issues consumers faced concerning the lack of ventilation in the grills. We are optimistic that the court will approve it.”
